Hungary residence permit through a company: business residence for founders and directors

A Hungarian residence permit for the founder and managing director of a Hungarian company that genuinely trades. Under Act XC of 2023 this is the residence permit for guest self-employment: issued for 1 year, extendable to a total of 3 years, with a 21-day decision under the immigration authority’s factsheet. For entrepreneurs ready to run a real business in an EU country, not to hold a company on paper. This is residence, not citizenship: the Indian passport stays.

Legal basis
Act XC of 2023residence permit for guest self-employment: for self-employed persons and for chief executives (ügyvezető) of Hungarian companies, cooperatives and other legal entities
Business test
Genuine activityeither the company has employed 5 Hungarian or EEA nationals full-time for at least 6 consecutive months, or your presence in Hungary is essential to its operation and, on a detailed declaration of business activity, it is likely to earn enough to sustain itself. No tax debts or enforcement proceedings
Permit term
1 year + up to 2 yearsno more than 3 years from first issue; extension requires at least 90 days in Hungary in any 180-day period
Next step
Change of basisthis permit does not lead to the national residence card; a long-term status is planned through another basis, such as the Guest Investor Programme
  • The Hungarian business residence permit is the residence permit for guest self-employment under Act XC of 2023. It is issued to a third-country national who pursues an independent activity for remuneration or acts as chief executive of a Hungarian company. It is neither the Golden Visa (Guest Investor Programme) nor the White Card for remote employees.
  • The company must genuinely trade. The immigration authority’s (OIF) factsheet gives two alternative tests: 5 Hungarian or EEA nationals employed full-time for at least 6 consecutive months, or your presence being essential to the company and a detailed declaration of business activity showing it can earn enough to sustain itself. Companies without turnover do not pass.
  • The permit is issued for 1 year and extended for up to 2 more years, but never beyond 3 years from first issue. Extension requires at least 90 days in Hungary in any 180-day period. The decision takes 21 days; in our practice the whole path from company registration to status takes six months to a year.
  • The minimum registered capital of a Kft is HUF 3,000,000, with a minimum contribution of HUF 100,000 per member. Corporate tax is 9%, local business tax up to 2%, personal income tax 15%. For Indian founders the capital and running costs are remitted under LRS, which we plan in advance.
  • An honest limitation: this permit does not lead to the national residence card, and the family can join only 1 year after your permit is issued. A long-term status in Hungary is planned through a change of basis, and we cost that from the start.

What you get

Your own business in an EU country

You own and run a Hungarian company while living in Hungary. The company’s income, contracts with European clients and accounts become the basis of your status.

No investment contribution

No fund units to buy and no donation to make. The outlay is the Kft’s registered capital from HUF 3,000,000 and the cost of genuine business activity, which stays in your business.

Low business taxes

Corporate income tax has been 9% since 2017 and local business tax is capped at 2%. Personal income, including dividends, is taxed at 15%.

A clear decision period

The OIF factsheet allows 21 days for the decision, excluding requests for further documents. The application is filed at the consulate or, for visa-free nationals, via the Enter Hungary platform.

The family joins

One year after your permit is issued, your spouse and minor children receive family reunification permits for up to 3 years.

Schengen without a visa

With a Hungarian residence permit you enter other Schengen countries without a visa and stay for up to 90 days in any 180.

Official requirements

Facts verified October 8, 2026

The company and your role in it
A Hungarian company (usually a Kft), cooperative or other legal entity in which you are appointed chief executive. The minimum registered capital of a Kft under the Civil Code is HUF 3,000,000, the minimum contribution per member HUF 100,000. The company extract and founding documents form part of the dossier.
Genuine business: one of two tests
Either the company has lawfully employed 5 Hungarian or EEA nationals full-time for at least 6 consecutive months, or your residence in Hungary is essential to its operation and, on a detailed declaration of business activity, it is likely to generate income sufficient to sustain itself. The declaration is supported by contracts, agreements and sales documents.
A clean tax record for the company
Tax authority certificates that the company has no tax or contribution debts, is not under enforcement or liquidation, and has met its employee registration and tax obligations.
For the self-employed: income above 24 minimum wages
A sole proprietor proves the registration number and a tax authority certificate that annual income exceeds 24 times the minimum wage. The 2026 minimum wage is HUF 322,800 (Decree 426/2025), so the threshold is HUF 7,747,200 a year.
Means of subsistence
Proof that you can cover living costs, accommodation, departure from Hungary and healthcare from lawful income and savings: bank statements, income certificates or the company’s declaration of activity. The factsheet sets no fixed amount.
Accommodation and insurance
A lease, proof of ownership or a document confirming accommodation provided to you in Hungary. Comprehensive health insurance or funds to pay for treatment.
Where to file
At the Hungarian consulate in your country of nationality or habitual residence. Visa-free nationals filing for the first time may use the Enter Hungary platform or the regional directorate of OIF inside Hungary; Indian citizens file through the consulate.

How the process works

  1. Diagnosis and choice of basis1–2 days

We check the business model, nationality, place of filing and family composition. We decide: business residence, White Card or Guest Investor Programme.

  2. Kft registration2–3 weeks

Articles, registered capital from HUF 3,000,000, registered office, your appointment as managing director, tax number, bank account. Registration with the company court is electronic and involves a lawyer qualified in Hungarian law.

  3. Launching the businesssix months to a year in our practice

Contracts with clients and suppliers, first transactions, hiring, bookkeeping and accounts. By filing time the company must show economic substance: without turnover and real work the application fails.

  4. Dossier and filingby appointment

Declaration of activity, tax authority certificates, proof of funds, accommodation and insurance, translations. Filed at the Hungarian consulate in New Delhi or Mumbai, or in Abu Dhabi for UAE residents; visa-free nationals may use Enter Hungary.

  5. Processing21 days

The decision under the OIF factsheet takes 21 days, excluding requests for further documents. We prepare answers to typical requests in advance.

  6. Card, extension and family1 + 2 years

You receive a 1-year permit. For extension you spend at least 90 days in Hungary in any 180 and file 40–90 days before expiry. One year after issue we file for family reunification.

How people actually use it

The official conditions are set out above. Below is how the programme works in real life, from our cases.

Shell companies do not pass

Companies without turnover and real work are refused. Registering a legal entity is not in itself a ground for residence: the migration authorities look at the economic substance of the business, not at its existence on paper.

Six months to a year to the status

In our practice the status is realistically obtained in six months to a year: by then the company is registered and its activity confirmed by contracts, transactions and accounts. The statutory 21-day decision is only the final stage.

Cost it with taxes and the running of the company

Business residence costs what a real company costs: accounting, office, payroll, taxes. We compare this route with other Hungarian bases, such as the White Card for remote work, and show the full price of the status.

Three years is a horizon, not a finish line

The permit is extended to a maximum of 3 years from first issue and gives no right to the national residence card. The decision on what comes next, a change of basis or a different route, is taken at the start, not a month before the card expires.

Andrey Boyko

The Hungarian business residence permit is a working route for an entrepreneur ready to run genuine activity in the country. In our practice the status is realistically obtained in six months to a year: by then the company must be registered and its activity confirmed by contracts, transactions and accounts.

The main limitation is an honest one: shell companies — companies without turnover and real work — do not pass. Registering a legal entity is not in itself a ground for residence: the migration authorities look at the economic substance of the business, not at its existence on paper.

We advise costing this route together with taxes and the expense of maintaining the company, and comparing it with other Hungarian grounds — for example the White Card for remote work (see the separate block). The specific requirements and timelines on the date of filing need to be checked before publication and filing.

Who the programme is for

Who this programme suits in our practice.

Owners of an existing business

You move part of your operations to Hungary: set up a Kft, appoint yourself managing director, sign contracts with clients and suppliers. The immigration authority assesses the economic substance of the company, not the fact of registration.

Directors with a team in Hungary

If the company has employed 5 Hungarian or EEA nationals full-time for at least 6 consecutive months, you qualify under the first criterion of the OIF factsheet without any assessment of whether your presence is essential.

Self-employed professionals

The same permit is open to a sole proprietor (egyéni vállalkozó) whose annual income exceeds 24 times the minimum wage: HUF 7,747,200 in 2026, certified by the tax authority.

Remote professionals who have outgrown the White Card

The White Card forbids a share in a Hungarian company and work for Hungarian clients. If the business must be Hungarian, the only route is business residence through a company. The comparison of the two bases is below.

Residence for the whole family: who can be included

For Garant IN the family is a core value. Under Act XC of 2023 the family of a company director joins under the family reunification permit, but with a time restriction. Below are the 2026 conditions under the OIF factsheets, without generic phrases.

  • Spouse or registered partner

The spouse and registered partner fall within the statutory definition of family. Reunification can be filed only 1 year after your business residence permit is issued; the exceptions are re-issue after 3 years and a child born in Hungary. The spouse’s permit runs for up to 3 years; the right to work arises only through the single application procedure with an employment component, it is not automatic.

  • Children

Minor children: biological, adopted and foster, as well as dependent minors in your custody. Adult children are not within the standard definition of family in the OIF factsheet. A child born in Hungary during the validity of your permit files without the one-year wait.

  • Parents

Parents of the applicant are not included in the list of family members for reunification with a company director. For parents we look at separate bases, such as the Guest Investor Programme, where the investor’s family includes dependent parents, or a permit of the parent’s own. We will not promise reunification with parents on business residence.

  • Costing for the family

There is no income threshold in euros, but accommodation, means of subsistence and comprehensive health insurance are proved for each family member. The fee is HUF 39,000 in person or HUF 26,000 via Enter Hungary, EUR 110 at the consulate, for each person. Marriage and birth certificates are apostilled and translated. For extension each member must spend at least 90 days in Hungary in any 180.

Filing is 1 year after the main permit is issued; the decision under the OIF factsheet takes 21 days. Garant IN's migration programme experts prepare each family member’s dossier to 2026 requirements in advance to exclude a refusal for an individual applicant. Verified on 6 October 2026 against the OIF factsheets.

What we do that others will not

The OIF factsheet conditions are the same for everyone. The difference is whether your particular company passes the economic-substance test and what happens to your status after three years.

  1. Business model check before the company is registered

We first establish which test your company will meet: a staff of 5 local employees, or your essential presence plus income. If the model does not pass, we say so before you have paid in capital and rented an office.

  2. A declaration of activity an officer can read

The detailed declaration of business activity is the key document of the dossier. We build it from real contracts, agreements and sales documents, not from general statements of intent.

  3. Company and personal tax in one model

We cost the 9% corporate tax, local business tax, 15% on dividends and the social contribution tax together with accounting, office and payroll. You see the full annual cost of the status, not just the fee. For Indian founders we add LRS remittance planning.

  4. A strategy for three years and beyond

This permit is capped at 3 years and does not lead to the national residence card. We plan the next step in advance: the Guest Investor Programme, another basis, or the EU residence card after 5 years of lawful residence.

  5. An honest comparison with the White Card and the Golden Visa

If you need a base for a year without a Hungarian company, the White Card is cheaper. If you need a 10-year status without presence, that is the Guest Investor Programme. We choose business residence when the business will really be Hungarian.

Wording pending approval.

What this programme is and who it suits

‘Business residence’ is the everyday name. In Act XC of 2023 it is the residence permit for guest self-employment (vendég-önfoglalkoztatás), granted to sole proprietors and to the chief executives of Hungarian companies, cooperatives and other legal entities. The Hungarian company is not a formality here but the basis of the status: the immigration authority checks that the business exists in reality, with contracts, transactions, staff, accounts and no tax debts.

The programme suits owners of an existing business who are ready to move part of their operations to Hungary and manage the company from the country, and self-employed professionals with income above 24 minimum wages a year. The permit is issued for 1 year and extended to a total of 3 years; after a year your spouse and minor children join you. For Indian entrepreneurs it is a way to run a company inside the EU with a 9% corporate tax while keeping the Indian passport.

It does not suit those who want an EU status without presence and without a real business, for whom there is the Guest Investor Programme with a 10-year permit. Nor those who work remotely for a foreign employer and have no plans for a Hungarian company, for whom the White Card is simpler; we compare the two below. This permit does not lead to the national residence card, so we plan the long-term strategy at the start.

What comes next

Extension to 3 years

We file 40–90 days before expiry, no later than 30 days before. Conditions: the company trades and has no tax debts, you have spent at least 90 days in Hungary in any 180, and you have met your notification duties.

Family after one year

One year after your permit is issued, your spouse and minor children apply for family reunification permits of up to 3 years. The 90-days-in-180 rule applies to their extensions too.

Long-term status through a change of basis

The national residence card is not granted on this permit, and from inside Hungary you cannot switch to an employment permit or the Hungarian Card. Working options: the Guest Investor Programme (10-year permit) or the EU residence card after 5 years of lawful residence; its factsheet does not exclude time on business residence, but the 3-year cap means another basis is needed for the remaining period.

Citizenship after 8 years

Under Act LV of 1993 naturalisation is possible after 8 years of residence in Hungary with a permanent residence document and registered address, housing and income, a clean record and an exam in constitutional basics in Hungarian. The decision is discretionary. India does not recognise dual citizenship, so this is a separate decision we discuss in advance.

Who files your application

Two levels of quality control: Garant IN's migration consulting and case management department runs a rigorous pre-application compliance screening (Pre-Due Diligence) and prepares the document package to 2026 requirements, while the application in Hungary is prepared and filed together with licensed local lawyers and authorised agents. This is how we minimise the risk of refusal at the preparation stage, before the documents reach the government authority.

Frequently asked questions

How does business residence differ from Hungary’s Golden Visa and White Card?

They are three different bases under Act XC of 2023. Business residence is the permit for guest self-employment: you run a Hungarian company with genuine activity, status for 1 year extendable to 3. The Golden Visa (Guest Investor Programme) is a 10-year permit for fund units from EUR 250,000 or a donation from EUR 1,000,000, with no presence requirement. The White Card is a year plus a year for remote work for a foreign employer with income from EUR 3,000 a month, and a ban on holding a share in a Hungarian company.

Do I have to hire 5 employees?

No, that is one of two alternative tests. If the company has employed 5 Hungarian or EEA nationals full-time for at least 6 consecutive months, you qualify under the first. Without such staff you must show that your presence in Hungary is essential to the company and that, on a detailed declaration of activity, it will earn enough to sustain itself. For a new company this is the second path, and it needs real contracts and transactions.

What registered capital is needed and what happens to it?

The minimum registered capital of a Kft under the Civil Code is HUF 3,000,000, with a minimum contribution of HUF 100,000 per member. The capital is paid into the company’s account and remains the company’s money: it is used in the business, not frozen on deposit. For Indian founders the remittance is made under the Liberalised Remittance Scheme, which we plan with the bank in advance.

How long does the whole process take?

The statutory decision period is 21 days, but you can file only once the company is already trading. In our practice six months to a year pass from company registration to status: that is when the contracts, transactions and accounts appear that prove the economic substance of the business. We do not promise ‘within a month’.

Where do I file: at the consulate or in Hungary?

As a rule, at the Hungarian consulate in your country of nationality or habitual residence: for Indian citizens that is the consulate in New Delhi or Mumbai, for UAE residents the embassy in Abu Dhabi. Filing inside Hungary via Enter Hungary or the regional directorate of OIF is open only to visa-free nationals on a first application and to holders of an extendable permit.

Do I have to live in Hungary?

For extension, yes: the OIF factsheet requires at least 90 days in Hungary in any 180-day period on the permit. For the first issue no presence condition is written separately, but the test ‘your residence is essential to the operation of the company’ assumes you run the business from Hungary.

Can business residence lead to permanent residence and citizenship?

The national residence card (indefinite residence after 3 years) is not granted to holders of the guest self-employment permit. The EU residence card after 5 years of lawful residence does not exclude this permit, but because of the 3-year cap another basis is needed for the remaining period. Citizenship comes after 8 years of residence with a permanent residence document and an exam in Hungarian. India does not recognise dual citizenship, so we build the long-term strategy at the start.

What taxes do the company and I pay?

Corporate income tax is 9% since 2017, local business tax up to 2% set by the municipality. Personal income tax, including on dividends, is 15%; above the annual cap a 13% social contribution tax is added to dividends. Tax residence and the India–Hungary double taxation agreement are checked before you move.

Can I take a job with a Hungarian company at the same time?

From inside Hungary a holder of the guest self-employment permit cannot apply for an employment permit or the Hungarian Card: the OIF factsheet expressly forbids it. If employment is in your plans, the basis must be chosen before the first filing.

Are there restrictions by the applicant’s nationality?

The OIF factsheet for this permit contains no list of excluded nationalities. In practice what matters is the place of filing, the ability to open a company account with a Hungarian bank and the origin of funds. For Indian applicants we plan the LRS remittance of capital and running costs and the bank’s source-of-funds checks before the company is registered.

Can I include parents or adult children in a Hungarian business residence application?

No. Under the OIF factsheet the family for reunification is the spouse or registered partner and minor children, including dependants and children in your custody. Parents and adult children are not on the list. For them we select a separate basis: a permit of their own or the Guest Investor Programme, where dependent parents are included in the investor’s family.

How do the requirements change when filing with a family in Hungary?

The income threshold does not rise, because there is none: instead, accommodation, funds and insurance are proved for each family member, and each application carries a fee of HUF 39,000 in person, HUF 26,000 via Enter Hungary or EUR 110 at the consulate. The main difference is timing: the family may file only 1 year after your permit is issued, except for a child born in Hungary.

Do you offer a refund if the application is refused?

Yes. If the application is refused through the fault of our team or an error in building the case, we refund the company's service fee less a minimal retention for costs actually incurred. Refund terms, the payment schedule and the rules on retaining service costs are fixed in the contract before work begins. Before we start, we check your documents and risk history free of charge and tell you about any risks in advance.
