  • The Slovak residence permit through business is temporary residence for the purpose of business under Section 22 of Act No. 404/2011 on the Residence of Foreigners. Two forms: sole trader (živnosť) or executive (konateľ) of a Slovak company, usually an s.r.o. Being a mere shareholder is not enough.
  • There is no investment contribution. You show account balances: in a personal account at least the subsistence minimum per month (EUR 295.22 from 1 July 2026), for a stay over a year 12 times that (EUR 3,542.64); in a separate business account 20 times the minimum (EUR 5,904.40) for a sole trader or 100 times (EUR 29,522) for a company executive.
  • The permit is issued for the expected duration of the business, no longer than 3 years, and is renewed for 3 years. Decision: 90 days from a complete file; 30 days for executives who are OECD nationals, significant investors and innovative projects. The fee is EUR 350 at the embassy.
  • From 15 July 2026 renewal requires proof that the business really works: a sole trader needs taxable income above EUR 2,876.90 a year, a company must have paid the minimum tax of EUR 340 to 11,520 depending on income; no arrears with the tax, customs, social and health insurance authorities for the whole term of the permit.
  • The family joins by reunification after your permit is issued: spouse, children under 18, dependants, dependent parents, for the term of your permit, up to 5 years. After 5 years of continuous residence, long-term residence (permanent residence); after 8 years of permanent residence, citizenship.

What you get

No investment contribution

No money goes into a fund or is locked in property: you prove balances in your personal and business accounts and they remain your working capital.

Up to 3 years from the start

The permit is issued for the expected duration of the business, up to 3 years, not for one year with annual renewals. Renewal is for another 3 years with a working business.

Two forms to choose from

A sole trader (živnosť) is cheaper in terms of the funds threshold and simpler in structure. A company (s.r.o.) has a higher threshold but is a full legal entity for contracts, a team and partners. We choose for the goal, not out of habit.

Family together

Spouse, children and dependent parents receive a reunification permit for the term of yours. Family members may do business; employment in the first 9 months requires a work permit.

Schengen

With a Slovak residence permit you enter other Schengen countries without a visa and spend up to 90 days there in any 180 days.

Path to permanent residence and citizenship

5 years of continuous legal residence give the right to long-term residence; 8 years of permanent residence give the right to Slovak citizenship with knowledge of the language.

Official requirements

Facts verified October 12, 2026

Business form: sole trader or company executive
Either a trade licence (živnostenské oprávnenie) in your name, or the role of executive (konateľ) in a Slovak company under a memorandum of association with notarised founders' signatures or a commercial register extract. Non-OECD nationals also need a commercial register entry as an enterprise of a foreign person for the sole-trader route.
Business plan
Proof of the purpose of stay: a business plan (podnikateľský zámer) in the form set by a separate regulation, or a document proving the right to do business. For a company a business plan with expected start-up costs or the founding documents and register extract suffice. The document must be no older than 90 days.
Funds for residence
A personal account statement for the last 3 months: at least the subsistence minimum for each month of stay, EUR 295.22 (Measure 155/2026, from 1 July 2026); for a stay over a year, 12 times the minimum, EUR 3,542.64.
Funds for the business
A statement from a separate business account for the last 3 months: 20 times the minimum (EUR 5,904.40) for a sole trader, 100 times (EUR 29,522) for a company executive, 40 times (EUR 11,808.80) with a business plan for an innovative project. The account may be with a foreign bank.
Accommodation
Proof of accommodation for at least 6 months: a declaration of ownership, a lease with the owner, a hotel confirmation or a notarised declaration by the owner providing accommodation.
Police clearances
From the country of citizenship and from every country where you lived for more than 90 days within 6 consecutive months in the last 3 years. The certificate must cover the whole territory of the state, with apostille or consular legalisation, Slovak translation, no older than 90 days.

How the process works

  1. Diagnostics1–2 days

We check nationality, business profile, source of funds, family composition and countries of residence over 3 years. We choose the form: sole trader or company.

  2. Business and account registration2–4 weeks

Founding documents of the s.r.o. with notarised signatures or the živnosť application, register entries, opening of personal and business accounts, preparation of the business plan.

  3. Dossier2–4 weeks

Police clearances with apostille, proof of accommodation for 6 months, 3-month statements, photo 3 × 3.5 cm, Slovak translations. All documents no older than 90 days on the filing date.

  4. Embassy filingby appointment

In person at the Slovak embassy accredited for your country of citizenship or residence. A first application for a business permit is not accepted inside Slovakia, only when changing the purpose of an existing permit.

  5. Processing90 days

The Foreign Police decide within 90 days of a complete file; 30 days for executives who are OECD nationals, significant investors and innovative projects. We answer requests at once.

  6. Entry, card and obligationsup to 180 days

Entry within 180 days of approval, registration within 3 working days, residence card, insurance within 3 working days of the card, medical report within 30 days. Then the business, reporting and presence in the country for more than half the term.

How people actually use it

The official conditions are above. Below is what these rules mean in a real case.

The status rests on a working business, not a registration certificate

Before 2026 renewal often went through on formal grounds. Now renewal checks the sole trader's taxable income or the company's tax paid, and arrears with the tax office, customs and insurance funds. A company that merely sits in the register gives no basis for renewal.

Money is a balance, not a contribution

The thresholds of EUR 5,904.40 and EUR 29,522 are proven with 3-month statements, and after filing the funds remain at your disposal. But the accounts must be different, personal and business, and the history of inflows must be clear.

Presence in the country is a condition, not a formality

Living outside Slovakia for more than half the permit term, or continuously for more than 180 days without notice, is a ground for cancellation. If the plan is to live in Dubai and keep a Slovak permit 'just in case', this must be discussed honestly before filing.

The family comes second but is prepared first

The law ties the family's permit to your issued permit, so simultaneous filing is not possible. We prepare the family dossier in parallel and file right after your decision, so the gap is weeks, not months.

Who the programme is for

Who this programme suits in our practice.

Business owners

You set up a Slovak company (usually an s.r.o.) and become its executive. The basis is the konateľ role, not the shareholding. You show EUR 29,522 in the business account.

Professionals and sole traders

You register a živnosť, the Slovak equivalent of a sole proprietorship, for your profession: consulting, IT, crafts, trade. The business-funds threshold is lower: EUR 5,904.40. Nationals of non-OECD countries, including India and the UAE, also need an entry in the commercial register as an enterprise of a foreign person.

IT and digital teams

You move contracts and a team into a Slovak legal entity and work from the EU for clients worldwide. For an innovative project the funds threshold drops to 40 times the minimum: EUR 11,808.80.

Families who need an EU base

A permit for up to 3 years from the start, Schengen, schools and healthcare under insurance. Spouse and children join by reunification for the term of your permit.

Residence for the whole family: who can be included

For Garant IN the family is a core value: the Slovak business residence permit extends to your loved ones under Section 27 of Act 404/2011 (temporary residence for the purpose of family reunification). Below are the rules as of October 2026 from the Act and the explanations of the IOM Migration Information Centre, without generic phrases.

  • Spouse

The spouse of a foreigner with temporary or permanent residence in Slovakia, provided both spouses are 18 or older. The permit is issued for the term of yours, no longer than 5 years. The spouse may do business; employment in the first 9 months requires a work permit. Fee EUR 200, renewal EUR 100.

  • Children

Unmarried children under 18, yours or your spouse's. Adult unmarried children are included if, because of a long-term unfavourable health condition, they cannot care for themselves and depend on you. Children under 18 file without a fee. Birth certificates with apostille and translation are required; for a child from a previous marriage, the other parent's consent.

  • Dependent parents

A parent of the applicant or of the spouse who depends on your care and lacks appropriate family support in the country of origin. Dependence is proven with documents: the parent's income and expenses, medical reports, transfers. The Act sets no age threshold.

  • Family budget

There is no separate investment threshold for family members: the business funds (EUR 5,904.40 or EUR 29,522) do not depend on family size. For each family member, accommodation and funds for residence are shown: the benchmark is the subsistence minimum of EUR 295.22 a month per person, EUR 3,542.64 for a stay over a year. Fees: EUR 200 per adult, children under 18 free; residence card EUR 10. A couple with two children: EUR 400 in fees plus EUR 40 for cards.

The family files after your permit is issued; the law ties their permit to yours, and simultaneous filing is not provided for. The reunification decision takes 90 days. Garant IN's migration programme experts prepare each family member's documents in parallel with yours to file right after your decision and rule out a refusal for an individual applicant. Verified on 2 October 2026 against Act 404/2011 and mic.iom.sk materials.

What we do that others will not

The conditions are the same for everyone. The difference lies in which form to choose and how to assemble the accounts and the business plan so that both the first filing and the 2026-rules renewal go through.

  1. The form for the goal: sole trader or company

For a solo professional a živnosť with a EUR 5,904.40 threshold makes more sense than a company with EUR 29,522. For a business with contracts and a team it is the reverse. We factor in nationality: outside the OECD the sole trader needs a commercial register entry, and the 30-day term for executives is available only to OECD nationals.

  2. A business plan that survives renewal

From 15 July 2026 renewal depends on real income and tax paid. We write the plan for figures the business will actually show, not for a pretty presentation; otherwise in 3 years the applicant is left without a basis.

  3. Clean accounts

Personal and business accounts are separate accounts, statements for 3 months, balances as of the certificate date. We prepare the flow of funds in advance so that on filing day nobody is searching for where the money came from. For clients from India we plan the remittance within the LRS limit.

  4. Family without losing time

The family files by reunification after your permit is issued, but we prepare each dossier in parallel with yours to file on the first day after the decision.

  5. Support while in status

The permit is cancelled if you live outside Slovakia for more than half of its term or build up tax and contribution arrears. We put deadline, reporting and presence controls in place for the whole period until renewal.

Wording pending approval.

What this permit is and who it suits

The Slovak residence permit through business is temporary residence for the purpose of business under Section 22 of the Act on the Residence of Foreigners. The state does not ask for a fund contribution or a property purchase: the basis is your own business activity in the country. It is either a sole trader (živnosť) or the executive role in a Slovak company, most often an s.r.o.

The programme suits three types of applicant. The first is a business owner who moves contracts and a team into an EU legal entity and runs it from Slovakia. The second is a professional for whom sole trader status is enough: a consultant, a developer, a craftsman. The third is a family that needs a Schengen base with a permit for up to 3 years from the start, schools and healthcare under insurance. For entrepreneurs from India and the UAE it is one of the few EU statuses with no investment contribution and a three-year first permit.

It does not suit those who want to hold the status ‘on paper’: from 2026 renewal depends on real income and tax paid, and living outside Slovakia for more than half the term is a ground for cancellation. Nor is it a path to fast citizenship: only naturalisation after 8 years of permanent residence.

What comes next

Renewal for 3 years

We file before expiry. Conditions: the business keeps working, a sole trader has taxable income above EUR 2,876.90 for the previous tax period, a company has paid at least the minimum tax, and there are no arrears with the tax, customs, social and health insurance authorities. From 15.07.2026 this applies for the whole term of the permit, not only at renewal.

Long-term residence after 5 years

After 5 years of continuous legal residence, long-term residence status (permanent residence under Act 404/2011). Allowed absences: up to 6 consecutive months and up to 10 months in total. Required: Slovak at A2 level, stable income of at least 12 times the minimum per person (EUR 3,542.64), accommodation; fee EUR 250, decision in 90 days.

Citizenship after 8 years

Act 40/1993 on citizenship: 8 years of continuous permanent residence immediately before the application, an interview on the Slovak language and knowledge of the country, no criminal record. For spouses of Slovak citizens, 5 years.

Change of basis

If the business closes and you take a job with a Slovak company or decide to study, we switch to another purpose of stay through the Foreign Police. The accumulated residence period is kept.

Who files your application

Two levels of quality control: Garant IN's migration consulting and case management department runs a rigorous pre-application compliance screening (Pre-Due Diligence) and prepares the document package to 2026 requirements, while the application in Slovakia is prepared and filed together with licensed local lawyers and authorised agents. This is how we minimise the risk of refusal at the preparation stage, before the documents reach the government authority.

Frequently asked questions

How does the business residence permit differ from golden visas?

There is no investment contribution. The basis is your business activity in Slovakia: a sole trader or the executive of your own company. The money in the accounts is proven but stays yours. In return the state expects the business to really work: from 15 July 2026 renewal depends on taxable income and tax paid.

Sole trader or company: which to choose?

A sole trader (živnosť): business-funds threshold EUR 5,904.40, a simpler structure, but nationals of non-OECD countries such as India also need a commercial register entry as an enterprise of a foreign person. A company (s.r.o.): threshold EUR 29,522, but a full legal entity for contracts and a team; the basis is the executive (konateľ) role, not the shareholding. If the company runs an innovative project, the threshold drops to EUR 11,808.80.

How much money do I need to show?

Two accounts and 3-month statements. Personal: at least EUR 295.22 for each month of stay, EUR 3,542.64 for a stay over a year. Business: EUR 5,904.40 (sole trader) or EUR 29,522 (company executive). These are balances on the certificate date, not a payment to the state. The embassy filing fee is EUR 350. For applicants from India the whole amount fits within the annual LRS limit.

Can I apply while in Slovakia?

No. A first application for a residence permit for the purpose of business is filed in person at the Slovak embassy accredited for your country of citizenship or residence. Inside Slovakia you can file only when changing the purpose of an existing permit.

How long does the whole process take?

By law, 90 days from a complete file, 30 days for executives who are OECD nationals, significant investors and innovative projects. With business registration, document preparation and the embassy appointment, a realistic term from first meeting to card is 4–6 months, depending on the workload of the specific embassy. We do not promise 'one month'.

What must I do after arrival?

Enter within 180 days of approval. Register your residence within 3 working days; take out health insurance within 3 working days of receiving the card; within 30 days submit proof of insurance and a medical report from an infectious-disease specialist no older than 30 days. Missing deadlines is a ground for penalties and a cancellation risk.

How long must I live in Slovakia to keep the permit?

More than half of the permit term in each year. Continuous absence of more than 180 days without notifying the Foreign Police is a ground for cancellation. For future long-term residence, absences must not exceed 6 consecutive months and 10 months in total over 5 years.

What is checked at renewal?

That the purpose of stay continues and the business works. From 15 July 2026 a sole trader is checked for taxable income above EUR 2,876.90 for the previous tax period, a company for tax paid at least at the minimum (EUR 340 to 11,520 depending on income). There must be no arrears with the tax, customs, social and health insurance authorities for the whole term of the permit: on a report from the tax office, customs or an insurer the police may cancel the permit (Section 111(10) and Section 36(1)(f) of Act 404/2011 as amended by Act 128/2026). The renewal fee is EUR 200.

When can the family join and can they work?

After your permit is issued, by family reunification, for the term of your permit, up to 5 years. The spouse and children may do business; employment in the first 9 months requires a work permit. The fee is EUR 200 per adult; children under 18 are exempt.

How many years to permanent residence and citizenship?

Long-term residence after 5 years of continuous legal residence, with Slovak at A2 level and stable income of at least 12 times the subsistence minimum. Citizenship after 8 years of continuous permanent residence immediately before the application, with an interview on the language and knowledge of the country (Act 40/1993).

I live in the UAE. Where do I file and which documents from where?

At the Slovak embassy accredited for the UAE or for your country of citizenship. Police clearances are needed from the country of citizenship and from every country where you lived for more than 90 days within 6 consecutive months in the last 3 years, so usually from both India and the UAE. UAE documents are legalised through the UAE Ministry of Foreign Affairs, Indian documents with an apostille, and everything is translated into Slovak.

Does Slovakia offer fast-track citizenship?

No. Slovakia has no citizenship by investment programme. The only official route is naturalisation after 8 years of permanent residence. Anything that promises a passport sooner is not based on law, and we do not work with it.

Can I include parents or adult children in a Slovak business residence application?

Yes, by family reunification (Section 27 of Act 404/2011). Parents of the applicant or spouse, if they depend on your care and lack appropriate support in the country of origin. Adult children only if unmarried and unable to care for themselves because of a long-term health condition. The family files after your permit is issued; their permit runs for the term of yours, up to 5 years.

How does the funds threshold change when applying with a family in Slovakia?

The business-funds threshold does not change: EUR 5,904.40 for a sole trader or EUR 29,522 for a company executive regardless of family size. For each family member, accommodation and funds for residence are shown: the benchmark is the subsistence minimum of EUR 295.22 a month per person (EUR 3,542.64 for a stay over a year). The fee per adult is EUR 200; children under 18 are exempt.

Do you offer a refund if the application is refused?

Yes. If the application is refused through the fault of our team or an error in building the case, we refund the company's service fee less a minimal retention for costs actually incurred. Refund terms, the payment schedule and the rules on retaining service costs are fixed in the contract before work begins. Before we start, we check your documents and risk history free of charge and tell you about any risks in advance.
