Right to work
Noneno employment, no self-employment, no remote work for foreign companies. For remote work there is the Digital Nomad visa
Living in Spain
more than 183 days a yeara renewal condition under Article 64 of the Regulation: this is a permit for relocation, not a back-up status
  • The residence permit without the right to work (Non-Lucrative Visa, NLV) is a Spanish residence status for people who live on their own means and do not work. The legal basis is Immigration Law 4/2000 (Article 31) and the new Immigration Regulation, Royal Decree 1155/2024 (Articles 61–64), in force since 20 May 2025.
  • Funds in 2026 are 400 % of IPREM: EUR 2,400 a month, or EUR 28,800 for the first year. Each family member adds 100 % of IPREM, EUR 600 a month (EUR 7,200 a year). IPREM in 2026 is EUR 600 a month: the amount set by the 2023 Budget Law, which Spanish consulates quote for 2026.
  • You can prove either savings for the whole term of the permit or a regular income: pension, dividends, rent. Work is not allowed, neither in Spain nor remotely for foreign companies; for remote work there is the Digital Nomad visa.
  • Filing is only at the consulate for your place of residence. Under the Regulation the permit is decided within 1 month (no reply means the application is deemed refused), then the consulate issues the visa within a month. The first permit is for 1 year, renewals are for 2 years each, provided you have lived in Spain for more than 183 days in the year.
  • After 5 years of legal residence, permanent residence (larga duración); after 10 years, the right to apply for citizenship. After a year of residence you can switch to a permit with the right to work without a new visa (Article 191 of the Regulation).

What you get

No investment, no business

No property purchase, no fund contribution, no company to set up. One requirement: proven funds from EUR 2,400 a month for the applicant.

Savings qualify too

The Regulation accepts either funds for the whole term of the permit or a regular income. You can prove money in accounts, not only a pension or dividends.

Family together

Your spouse or partner and minor children receive visas at the same time as you. Each family member adds EUR 600 a month to the amount.

Visa-free Schengen

With a Spanish residence card you enter other Schengen countries without a visa and stay there for up to 90 days in any 180 days.

Life in Spain with children

School-age children attend Spanish schools: for the renewal this is a mandatory condition. You live in the country as a resident, not as a tourist with a limited stay.

Time counts towards permanent residence and citizenship

Years on the NLV count as legal residence: after 5 years, permanent residence; after 10, the right to apply for citizenship. After a year of residence you can switch to a permit with the right to work.

Official requirements

Facts verified October 13, 2026

Non-EU citizenship and lawful position
The visa is for citizens of countries outside the EU, the EEA and Switzerland. You must not be in Spain irregularly at the time of filing or be listed as refused entry to the Schengen area.
Funds: 400 % of IPREM
IPREM is Spain's reference indicator for thresholds; in 2026 it is EUR 600 a month (EUR 7,200 a year). The applicant needs 400 %, EUR 2,400 a month; each family member another 100 %, EUR 600 a month. The amount covers the whole term of the permit: EUR 28,800 for the first year for one person, EUR 36,000 for a couple. This is the minimum on the filing date.
How to prove the funds
Savings for the whole term or a regular income: pension, annuity, dividends, rent. For foreign accounts the bank states its name and address, the account details, the opening date, the balance on 31 December of the previous year and the average balance over the last year (Article 62 of the Regulation). The Embassy in New Delhi asks for a cover letter explaining all the documents on financial means.
No work, including remote work
The permit is for people who will live in Spain without any employment or professional activity. The Consular Section of the Embassy of Spain in Washington expressly requires a written commitment not to work, either on-site or remotely online. If the funds come from shares in a Spanish company, you must prove that you do not work in it.
Health insurance
Public or private insurance from a company authorised to operate in Spain, covering all the risks of the public health system, for the whole period. A travel policy does not meet these requirements.
Police clearance and medical certificate
Adults: police clearance from every country where you have lived in the last 5 years, apostilled or legalised and translated into Spanish. For Indian citizens this is the Police Clearance Certificate from the Passport Office, apostilled by the Ministry of External Affairs. Everyone: a medical certificate confirming no disease with serious public-health implications under the International Health Regulations 2005. The Embassy in New Delhi treats both documents as valid for 6 months.
Passport
Valid for at least 1 year. The Spanish Embassies in New Delhi and Abu Dhabi do not accept passports issued more than 10 years ago and ask for two blank pages.

How the process works

  1. Diagnostics and choice of route1–2 days

We check the source and size of the funds, the family composition, the country of filing and your plans for work. We decide: NLV, Digital Nomad or another residence permit.

  2. Document preparation2–6 weeks

Bank certificates and proof of income, insurance, police clearance and medical certificate, apostille and sworn translations, forms EX-01 and 790-052. The timing depends on the countries issuing the certificates: this is practice, not a statutory term.

  3. Filing at the consulateby appointment

In person at the consulate or visa centre for your place of legal residence. The visa application also starts the procedure for the residence permit in Spain.

  4. Processing1 + 1 month

Under the Regulation the immigration office decides on the permit within 1 month, then the consulate issues the visa within a month. Requests for documents must be answered within 10 days. The New Delhi and Abu Dhabi embassy pages state a legal period of 3 months from filing; appointments and seasonal workload lengthen the path, and this is not a statutory term.

  5. Visa, entry and residence card1 month

You collect the visa in person within a month of notification. Within a month of entering Spain you apply for the residence card (TIE). The visa's own validity is set by the consulate: the New Delhi and Abu Dhabi pages give 90 days.

  6. Life in status and renewals1 + 2 + 2 years

You live in Spain for more than 183 days a year and keep your insurance and funds. We file the renewal in the last 2 months before the permit expires; the decision takes up to 3 months. After 5 years, permanent residence.

How people actually use it

The official conditions are above. Below is what we look at in real cases.

The amount is proof of means, not the price of the permit

EUR 28,800 for the applicant and EUR 7,200 for each dependant show the consulate that you can live for a year without working. It is not a fee and not the cost of the status: the money stays yours, but its origin and availability must read unambiguously from the documents.

'Working quietly' on an NLV is a bad idea

If you intend to keep working remotely from Spain, the route to check is the Digital Nomad visa, not an NLV with a plan that nobody will notice. What matters is the type of employment, the foreign company or clients and the proven income.

Timelines depend on where you file

Time goes not only on the consulate's decision but also on appointments, apostilles, insurance and arranging housing. Timelines differ noticeably between filing locations, so do not plan the move around someone else's quick case.

Renewal and taxes are planned in advance

To renew the permit you must live in Spain for more than 183 days a year, and that means Spanish tax residency. We map the renewal conditions and the tax consequences of living in Spain before filing, not after the move.

Who the programme is for

A residence permit for people who do not need to earn in Spain: the money is already there or comes in by itself.

Retirees

A state or private pension, or a life annuity. The consulate checks that payments will keep coming for the whole term of the permit, not just in the month of filing.

Investors and rentiers

Dividends, interest, income from funds and securities, savings in accounts. If the funds come from shares in a Spanish company, you must prove that you do not work in it.

Property owners

You let homes or commercial premises and receive rent. You prove it with lease agreements and inflows to your account.

Career break

You have sold a business, left employment, are taking a sabbatical or raising children in Spain, and are ready not to work at all for that period. If the work continues online, the Digital Nomad visa is the route.

Residence for the whole family: who can be included

For Garant IN the family is a core value: on the NLV your loved ones receive visas at the same time as you, or come later through family reunification. Below are the 2026 conditions under Regulation 1155/2024 (Article 61) and Spanish consulates' pages, without generic phrases.

  • Spouse or partner

Marriage, a registered partnership or a stable couple: at least a year of living together, and with a child in common it is enough to prove cohabitation. The spouse needs no separate funds: the main applicant proves them, plus EUR 600 a month for the partner. Like the applicant, the spouse cannot work in Spain on the NLV.

  • Children

Minor children of the applicant or spouse who are unmarried and have not formed their own family. Adult children only with a disability requiring support, or if they cannot provide for themselves because of their health. Each child adds EUR 600 a month. For the renewal, school-age children must attend school.

  • Parents

The Regulation in force since May 2025 does not include parents in the NLV applicant's family. The New Delhi and Abu Dhabi embassy pages still mention dependent relatives in the ascending line, so we confirm the position with the consulate before filing. A parent can apply for their own NLV as main applicant with their own funds, EUR 2,400 a month, or come through reunification once you hold permanent residence, if over 65 and dependent on you (Articles 66 and 68).

  • Funds calculation for the family

EUR 2,400 a month for the applicant + EUR 600 for each family member, for the whole term of the permit. A couple: EUR 3,000 a month (EUR 36,000 for the first year); a couple with one child: EUR 3,600 (EUR 43,200); a couple with two children: EUR 4,200 a month (EUR 50,400 for the year). Fees per person: EUR 90 for the visa, EUR 10.94 for the permit and EUR 16.08 for the residence card. Indian bank certificates go with a sworn translation into Spanish.

Family visas are filed together with yours. If the family comes later, that is family reunification (reagrupación familiar): it can be filed once you have lived in Spain for a year and applied to renew for at least another year (Article 68 of the Regulation); a reunited spouse and children receive the right to work (Article 65). Garant IN's migration programme experts check every family member's documents in advance against 2026 requirements. What we do that others will not

The NLV threshold is the same for everyone. Refusals usually come not from the amount but from how the money is proven and how the consulate reads the purpose of the move.

  1. We separate NLV from Digital Nomad before filing

If your work continues, even remotely for a foreign company, the NLV is not your route. We compare both options against the family's task and tell you plainly which one fits.

  2. Funds the consulate reads unambiguously

Savings, a pension, dividends and rent are proven with different documents. We prepare bank certificates with balances and average balance as the Regulation requires, plus a cover letter with the calculation for the whole family.

  3. Filing from India or the UAE

We file at the consulate for your place of legal residence: New Delhi, Mumbai, or Abu Dhabi through the BLS centre in Dubai. We account for each consulate's requirements: validity of certificates, MEA apostille or legalisation, sworn translations.

  4. Funds moved within LRS

Residents of India move money abroad under the RBI's Liberalised Remittance Scheme. We plan transfers for the first year and for the 2-year renewal within the annual limits of each family member.

  5. A renewal plan from day one

To renew you must live in Spain for more than 183 days a year, keep your insurance and funds for the next 2 years, and keep school-age children in school. We file in the last 2 months before the permit expires.

Wording pending approval.

What this visa is and who it suits

NLV, or Non-Lucrative Visa, is the everyday name. In the law it is temporary residence without the right to work (residencia temporal no lucrativa). Since 20 May 2025 its conditions are set by the new Immigration Regulation: you move to Spain and live on your own means, without working either in the country or for clients abroad. First the consulate issues a visa that includes the residence permit, then in Spain you obtain the residence card.

The programme suits three types of applicant. The first is retirees with a state or private pension. The second is investors and rentiers: dividends, interest, income from funds, rent. The third is people with savings who are taking a break from work: they have sold a business, left employment or are raising children. In every case the funds must be at least 400 % of IPREM, which in 2026 is EUR 2,400 a month for the applicant plus EUR 600 for each family member. For families from India and the UAE it is a European residence route with no investment, as long as nobody in the family needs to keep working.

It does not suit people who keep working, even remotely for a foreign company: for that there is the Digital Nomad visa. Nor does it suit those who need a European status without moving: to renew the NLV you must live in Spain for more than 183 days a year.

What comes next

Renewal for 2 years

The application is filed in the last 2 months before the permit expires. Conditions: funds for the next 2 years, uninterrupted insurance, school-age children in school, more than 183 days in Spain in the calendar year. Decision within 3 months; silence means approval.

Permanent residence after 5 years

Long-term residence (larga duración) after 5 years of continuous legal residence. Allowed absences: no more than 6 months at a time and no more than 10 months in total over 5 years.

Citizenship after 10 years

The general naturalisation term is 10 years of continuous legal residence. Spain requires renunciation of the previous citizenship, with exceptions in the Civil Code only for Latin American countries, Andorra, the Philippines, Equatorial Guinea and Portugal. India, for its part, does not permit dual citizenship: a Spanish passport means giving up the Indian one, with the OCI card as a separate status.

Change of basis

After a year of residence you can switch to a permit with the right to work as an employee or self-employed without a new visa, if you meet the conditions of that permit (Art. 191 of the Regulation). The accumulated years are kept.

Who files your application

Two levels of quality control: Garant IN's migration consulting and case management department runs a rigorous pre-application compliance screening (Pre-Due Diligence) and prepares the document package to 2026 requirements, while the application in Spain is prepared and filed together with licensed local lawyers and authorised agents. This is how we minimise the risk of refusal at the preparation stage, before the documents reach the government authority.

Frequently asked questions

What is the NLV, and how does the visa differ from the residence permit?

NLV is the everyday name for the residence visa without the right to work. The visa application at the consulate also serves as the application for the residence permit: the immigration office in Spain first decides on the permit, then the consulate issues a visa that includes it. Within a month of entry you apply for the residence card (TIE). The permit is valid for 1 year and then renewed for 2 years.

What funds are required in 2026?

400 % of IPREM for the applicant and 100 % for each family member. IPREM in 2026 is EUR 600 a month, so the applicant needs EUR 2,400 a month, or EUR 28,800 for the first year, and each family member EUR 600 a month (EUR 7,200 a year). At renewal the funds cover 2 years: under Article 62 that is EUR 57,600 for the applicant and EUR 14,400 per family member. This is the minimum: we file with a margin, because the consulate also assesses where the money comes from.

Can I rely on savings only, without a regular income?

Yes. Article 62 of the Regulation accepts either funds for the whole term of the permit or a source of regular income. Bank statements and certificates, title deeds, certified cheques, and credit cards with a bank certificate of the available limit all qualify. For foreign accounts you need the balance on 31 December of the previous year and the average balance over the last year, so the history of the account matters, not just the balance on the day of filing.

Can I work remotely for a foreign company?

No. The NLV is for people who live in Spain without any employment or professional activity, and that includes remote work online. If you keep working, the route is the Digital Nomad visa. After a year on the NLV you can switch to a permit with the right to work without a new visa, if you meet that permit's conditions (Article 191 of the Regulation).

Can I apply while I am in Spain?

As a rule, no. The NLV is obtained through the Spanish consulate for your place of legal residence, in person. You cannot apply from Spain on a Schengen tourist visa: for this route the Regulation provides only a consular visa. Filing from inside Spain is possible, for example, for the Digital Nomad visa.

Do I have to live in Spain?

Yes, the NLV is a permit for relocation. To renew it you must have lived in Spain for more than 183 days in the calendar year (Article 64 of the Regulation). For permanent residence after 5 years, absences may not exceed 6 months at a time or 10 months in total. If you need a status without moving, the NLV does not fit.

Can I apply from India, and which consulate handles my application?

Yes. Applications from India go to the Embassy of Spain in New Delhi or the Consulate General in Mumbai, depending on your consular district; New Delhi accepts NLV applications in person at its Consular Section by appointment. The Embassy's page confirms the 2026 amounts: EUR 2,400 a month for the main applicant and EUR 600 a month for each family member. Indian documents (Police Clearance Certificate, marriage and birth certificates) are apostilled by the Ministry of External Affairs and translated by a sworn translator.

I live in the UAE. Where do I file?

At the Embassy of Spain in Abu Dhabi, through the BLS visa application centre in Dubai, in person and by appointment. Police clearance is required from every country where you have lived in the last 5 years, legalised or apostilled and translated into Spanish.

How do I move the funds from India?

Residents of India remit abroad under the RBI's Liberalised Remittance Scheme: each resident individual, including minors, can send up to USD 250,000 per financial year (April to March). The first year's funds for a family of four (EUR 50,400) fit within one person's limit, but the funds for the 2-year renewal, rent and a possible property purchase add up, so we plan transfers across family members in advance. For the visa itself a Spanish account is not required.

How much are the government fees?

The consular fee for a national visa is EUR 90 (Order AUC/891/2024), paid in local currency. The permit fee on form 790-052 is EUR 10.94, renewal EUR 16.40; the residence card costs EUR 16.08 on first issue and EUR 19.30 on renewal; permanent residence EUR 21.87 (Order PJC/617/2025). Every family member pays the fees.

How long does a decision take?

Under the Regulation the immigration office decides on the permit within 1 month of receiving the file from the consulate, and if there is no reply the application is deemed refused. The consulate then issues the visa within a month, and you must collect it in person within a month. The New Delhi and Abu Dhabi embassy pages state a legal period of 3 months from filing, and appointments lengthen the path further: this is not a statutory term, and we will not promise 'one month'. A renewal is decided within 3 months, and there silence means approval.

Do I have to pay tax in Spain?

If you spend more than 183 days in Spain in a calendar year, you become a tax resident and declare worldwide income, and that is exactly how long you must live there to renew the NLV. The special regime for relocated persons (Article 93 of the Personal Income Tax Law) is tied to moving for work or business activity, so it does not apply on the NLV. How Spanish residency interacts with your tax position in India or the UAE is something we work out before the move, taking double taxation agreements into account.

When can I get permanent residence and citizenship?

Permanent residence (larga duración) after 5 years of continuous legal residence. Citizenship after 10 years of legal residence, with renunciation of your previous citizenship: the Civil Code exceptions cover only Latin American countries, Andorra, the Philippines, Equatorial Guinea and Portugal. For Indian citizens there is a second side to this: India does not permit dual citizenship, so a Spanish passport means giving up the Indian one, with the OCI card as a separate status.

Can I include parents or adult children in a Spanish NLV application?

Adult children only if they have a disability requiring support or cannot provide for themselves because of their health (Article 61.3 of Regulation 1155/2024). Parents are not in the NLV family list under the Regulation, although some embassy pages, including New Delhi, still mention dependent ascending relatives; we confirm this with the consulate before filing. A parent can apply for their own NLV with their own funds (400 % of IPREM, EUR 2,400 a month) or come through reunification once you hold permanent residence, if over 65 and dependent on you.

How does the amount of funds change when applying with a family in Spain?

To EUR 2,400 a month for the applicant add 100 % of IPREM, EUR 600 a month, for each family member. A couple: EUR 3,000 a month; a couple with two children: EUR 4,200 a month, or EUR 50,400 for the first year. The main applicant proves the funds, and the amount covers the whole term of the permit.

Do you offer a refund if the application is refused?

Yes. If the application is refused through the fault of our team or an error in building the case, we refund the company's service fee less a minimal retention for costs actually incurred. Refund terms, the payment schedule and the rules on retaining service costs are fixed in the contract before work begins. Before we start, we check your documents and risk history free of charge and tell you about any risks in advance.
