Investment
from BRL 1,000,000real estate in an urban area, built or under construction; in the North and Northeast the threshold is 30 % lower: from BRL 700,000. Own funds of foreign origin, transferred through an institution licensed by the Central Bank
Status term
4 years → indefinitefirst permit for 4 years; converted to indefinite if the property is kept. Presence of at least 14 days in every 2-year period
Family
Spouse, children, parentsfamily reunion under article 37 of the Migration Law: spouse or partner, children, parents and other relatives up to the second degree; family members may work
  • Brazil’s residence permit through real estate is a residence authorisation (autorização de residência) under Migration Law 13,445/2017 and Normative Resolution 36/2018 of the National Immigration Council (CNIg): it goes to a foreigner who buys real estate in an urban area with their own funds of foreign origin.
  • The threshold is BRL 1,000,000 or more; for properties in the North and Northeast regions it is 30 % lower, from BRL 700,000. Built and off-plan properties qualify, several can be combined; co-ownership only if each co-owner invests the threshold; a loan is allowed only above the threshold.
  • The first permit is for 4 years (CNIg Resolution 46/2021); at its end, if the property is kept, it is converted to an indefinite permit. Presence in the country: at least 14 days in every 2-year period, consecutive or not, counted from registration with the Federal Police.
  • Family: spouse or partner, children, parents and other relatives up to the second degree obtain residence through family reunion for the same term and may work. Registration with the Federal Police within 90 days of entry; the CRNM resident card costs BRL 204.77.
  • Citizenship by naturalisation after 4 years of residence with Portuguese and no criminal conviction; with a Brazilian spouse or child, after 1 year. The Migration Law does not require renouncing a previous citizenship; Indian law on dual citizenship is a separate question we check with you.

What you get

An asset, not a contribution

The money goes into a flat, a house or several properties that can be let and resold. A loan is allowed for the part above BRL 1,000,000.

Minimal presence

The resolution requires only 14 days in every two years. The status suits those who are not ready to relocate now but want residence in a country of 200 million people.

A wide family circle

The Migration Law includes in family reunion not only the spouse and children but also parents, grandchildren, brothers and sisters where dependent. Family members receive status for the same term and may work.

Indefinite status after 4 years

After the first term the permit becomes indefinite if the property is kept. The resolution provides for no annual status fees.

Citizenship after 4 years

The Migration Law sets a minimum of 4 years of residence for ordinary naturalisation, 1 year with a Brazilian spouse or child. The law does not require giving up your previous passport.

No language or age filters on entry

No exams, degrees or proof of income are needed for the permit: the basis is the investment. Portuguese is needed later, at naturalisation.

Property in an urban area
Real estate in an urban area: built, with registered title, or under construction, under a registered purchase agreement with a building permit and the development record (memorial de incorporação).
Amount from BRL 1,000,000
From BRL 1,000,000, the total value of one or several properties. For the North and Northeast regions the threshold is reduced by 30 %: from BRL 700,000. Co-ownership is allowed if each co-owner has invested the full threshold.
Own funds from abroad
The money must be your own and of foreign origin, transferred to Brazil through a financial institution licensed by the Central Bank. Since 2024 the proof of transfer is a declaration from such an institution (RN 49/2024). A loan in Brazil only for the amount above the threshold. Remittances from India must fit the LRS limit per person per year.
Potential for jobs or income
Resolution 36/2018 describes the basis as an investment ‘with potential to generate jobs or income’. In practice this is shown by the purchase itself; no separate business plan is required.
General documents
Passport, police clearance certificate from the country of residence with apostille and sworn translation, civil status certificates, a statement of purpose, photographs. For the family: proof of kinship and dependency.
Presence in the country
At least 14 days in every 2-year period, consecutive or not, counted from the date of registration with the Federal Police. If presence is not met but the investment is kept, a new 4-year permit may be requested.
Registration and resident card
Within 90 days of entry: registration with the Federal Police and issue of the CRNM card (fee BRL 204.77). Without registration the status is not formalised and presence does not count.

How the process works

  1. Diagnostics and budget1–2 days

Goals, budget, region, family, source of funds. We decide: real estate, investment in a company or another basis.

  2. Property selection and checks2–8 weeks

Built or off-plan, one or several properties. Registry, encumbrances, developer checks. Preliminary contract.

  3. Deal and transfer of fundsas ready

Transfer from abroad through a bank licensed by the Central Bank, the bank’s declaration, notarial deed, registration of title or a registered contract for an off-plan property, ITBI tax.

  4. Filing the applicationafter registration of the deal

With the Ministry of Justice via MigranteWeb (while in Brazil) or at the consulate in your country of residence. Family documents at the same time.

  5. Decision and entryno statutory deadline

The resolution sets no processing deadline; we give an estimate based on the authority’s current practice on the filing date. After approval: entry and registration.

  6. Registration and life in the status90 days → 4 years

Registration with the Federal Police and CRNM within 90 days. Then 14 days in two years, keeping the property, and after 4 years conversion to indefinite status.

How people actually use it

The official conditions are above. Below is what we look at when accompanying the purchase and the filing, based on the text of the CNIg resolutions.

The North and Northeast are 30 % cheaper, but count the exit

The BRL 700,000 threshold applies in Manaus, Fortaleza, Recife, Salvador and the whole region. Liquidity and rental demand differ from São Paulo: a saving on entry should not cost you a loss on resale.

A property for two means the threshold from each

The resolution allows co-ownership only if each co-owner has invested the full amount. For spouses it is better to register the property to one and bring the family through family reunion.

14 days in two years is not enough for citizenship

Minimal presence keeps the permit, but naturalisation requires 4 years of residence and Portuguese. If the goal is a passport, we plan real life in the country, not formal visits.

The money must come through a licensed bank

Since 2024 the proof of transfer is a declaration from an institution licensed by the Central Bank. Transfers through third parties or cash do not work for the permit; from India the transfer is planned within the LRS.

A non-refundable contribution is easier to evaluate: the money is spent on obtaining the status and does not come back as an investment. Real estate is a harder calculation — purchase price, upkeep, commissions, the mandatory holding period and, above all, a realistic future buyer.

The choice, then, is not just the difference in the entry amount. Sometimes a higher non-refundable cost is clearer and safer than a formally refundable investment with an uncertain exit. Every property must be assessed as a standalone asset.

Who the programme is for

Who this programme suits in our practice.

Investors in big-city real estate

You buy a flat, a house or several properties in São Paulo, Rio de Janeiro, Florianópolis or on the Northeast coast and receive resident status together with an asset you can let and resell.

Families who want a second base

The status does not require relocation: 14 days in two years. Spouse, children and parents are included in the application, and after 4 years the permit becomes indefinite.

Entrepreneurs and remote professionals

A Brazilian resident lives, does business and opens accounts in the country; the status is not tied to employment. Tax residency is planned separately for your situation, including Indian and UAE income.

Those comparing with investment in a company

There is a second route: residence for an investor in a Brazilian company (CNIg RN 13/2017). The threshold is lower, but an operating business and a plan are required. The comparison is below.

Residence for the whole family: who can be included

For Garant IN, family is a core value: residence through family reunion is arranged for your close relatives with you or later under article 37 of Law 13,445/2017 and Interministerial Ordinance 12/2018. Below are the conditions from those documents, without generic phrases.

  • Spouse or partner

Spouse or partner in a stable union (união estável) without any discrimination, including same-sex couples. A marriage concluded by proxy is not accepted as a basis. The status runs for the same term as yours; the partner may work and do business on equal terms with citizens.

  • Children

The applicant’s children are included on the birth certificate with no age limit in the text of the ordinance; for adult children, proof of dependency is requested in practice. Stepchildren: under 18, up to 24 if in full-time education, or at any age if economically dependent. Grandchildren qualify as descendants up to the second degree.

  • Parents, brothers and sisters

The applicant’s parents and grandparents (ascendants up to the second degree) are included with no minimum age; kinship, and dependency where applicable, must be proven. Brothers and sisters: under 18, up to 24 if studying, or where economically dependent.

  • Family budget

The investment threshold does not grow with the family: one property from BRL 1,000,000 covers everyone. Do not split ownership: with co-ownership the threshold is required from each co-owner. Fees apply per family member: CRNM BRL 204.77 and the GRU processing fee; plus apostille and sworn translation of marriage and birth certificates. Remittances from India are planned within the LRS limit per person.

Filing together with the main applicant or later; the family’s permit term matches yours, and once your status becomes indefinite, theirs is converted too. Garant IN's migration programme experts check each family member’s documents before filing. Data verified on 2 October 2026 against Law 13,445/2017, Decree 9,199/2017 and Ordinance 12/2018.

What we do that others will not

The resolution’s conditions are the same for everyone. The difference is which property you buy, how the deal is structured and whether the money came by a route the Ministry of Justice will accept.

  1. Property checks before the deposit

Registry extract (matrícula), encumbrances, tax and condominium debts, the building permit and the development record with the developer. We do not recommend a property ‘with documents in progress’ for the permit.

  2. Purchase structure for the family

Co-ownership requires the threshold from each co-owner, so for the family’s status the property is usually registered to one applicant and the family comes through family reunion. We work through the options before the contract is signed.

  3. The money trail

The Ministry accepts the transfer only through an institution licensed by the Central Bank, with its declaration. We prepare the proof of source of funds and the transfer route, including LRS limits for Indian residents, so the money does not get stuck in bank compliance.

  4. Filing route

Two routes: the permit from the Ministry of Justice via MigranteWeb while in Brazil, or a visa through the Brazilian consulate in New Delhi, Mumbai or the UAE. We choose by travel plans, family composition and document readiness.

  5. Status calendar

14 days in two years, Federal Police registration, conversion to indefinite status after 4 years, naturalisation: we keep the calendar for you so that no deadline is missed.

Wording pending approval.

What this status is and who it suits

Brazil’s residence permit through real estate is a residence authorisation (autorização de residência) under Migration Law 13,445/2017. The conditions were set by the National Immigration Council (CNIg) in Normative Resolution 36/2018: a foreigner buys real estate in an urban area for BRL 1,000,000 or more with their own funds of foreign origin and receives resident status. Resolution 46/2021 set the first term at 4 years and the minimum presence at 14 days in every two years; Resolution 49/2024 added the requirement to prove the transfer of money with a declaration from an institution licensed by the Central Bank.

The route suits investors who want to hold an asset in Latin America’s largest economy and have residence without relocating; families from India or the UAE who want a second base with the option of including parents; and entrepreneurs who want to decide for themselves when and how long to live in the country. After four years the permit becomes indefinite, and naturalisation is possible after four years of real residence.

It does not suit those looking for ‘a passport for buying a flat’: residence and citizenship are different stages, and the second needs years of life in the country and Portuguese. Nor does it suit those planning to pay for the property in cash or through third parties: the Ministry of Justice accepts only a transfer through a licensed bank, and from India the transfer is planned within the LRS.

What comes next

Indefinite status after 4 years

We file for conversion of the permit to indefinite with proof that the property remains in your ownership. If the first permit was issued for a shorter term, it can be renewed until conversion.

If presence was not met

Resolution 46/2021 allows a new 4-year permit to be requested if the investment is kept. We keep a travel calendar so it does not come to that.

Citizenship

Ordinary naturalisation: 4 years of residence, Portuguese, no criminal conviction; 1 year with a Brazilian spouse, partner or child. The Migration Law does not require renouncing a previous citizenship; for Indian citizens, the OCI route after naturalisation is a separate conversation.

Selling the property

Before conversion to indefinite status, a sale removes the basis. If you plan to exit the asset earlier, we calculate a replacement property or another route in advance.

Who files your application

Two levels of quality control: Garant IN's migration consulting and case management department runs a rigorous pre-application compliance screening (Pre-Due Diligence) and prepares the document package to 2026 requirements, while the application in Brazil is prepared and filed together with licensed local lawyers and authorised agents. This is how we minimise the risk of refusal at the preparation stage, before the documents reach the government authority.

Frequently asked questions

What is Brazil’s residence permit through real estate and what is it based on?

It is a residence authorisation under Migration Law 13,445/2017 and Decree 9,199/2017, with conditions set by the National Immigration Council in Normative Resolution 36/2018 as amended by Resolutions 46/2021 and 49/2024. The basis is the purchase of real estate in an urban area for BRL 1,000,000 or more with your own funds of foreign origin.

What is the minimum amount and how is the threshold calculated?

BRL 1,000,000 for one or several properties in an urban area. For the North and Northeast regions the threshold is 30 % lower, BRL 700,000. You may buy two properties at BRL 500,000 each: the total counts. A loan is allowed only for the part above the threshold.

Does an off-plan property qualify?

Yes. You need a registered purchase agreement, proof of the transfer of funds, the building permit and the development record (memorial de incorporação). We check the developer and the permits before the contract is signed.

How long do I have to live in Brazil?

At least 14 days in every 2-year period, consecutive or not, counted from registration with the Federal Police. That is the condition for keeping the permit. Naturalisation requires real residence of 4 years and Portuguese.

How long is the permit and what comes next?

The first permit is for 4 years. At its end, if the property is kept, the permit is converted to indefinite. If presence was not met but the property is kept, a new 4-year permit may be requested.

Can family members work?

Yes. Ordinance 12/2018 states expressly that a person granted residence through family reunion may carry out any activity, including paid work, on equal terms with Brazilian nationals.

Where do I apply: at the consulate or in Brazil?

Both routes are lawful. While in Brazil, you may apply to the Ministry of Justice via the MigranteWeb system (article 4 of Resolution 36/2018). From abroad, through the Brazilian consulate in your country of residence, in New Delhi or Mumbai for Indian residents or in the UAE for UAE residents: first the visa, then registration in Brazil. We choose by timing and family composition.

What must be done after approval?

Within 90 days of entry, register with the Federal Police and obtain the CRNM resident card (fee BRL 204.77 each). Presence and the permit term are counted from the registration date.

Do I have to pay taxes in Brazil?

Owning property brings the local property tax (IPTU) and taxes on purchase and sale. Tax residency and declaring worldwide income depend on how long you live in the country and in what status; we work this out before the purchase, not after, together with your Indian or UAE tax position.

How many years to citizenship, and do I have to give up my own?

Ordinary naturalisation: 4 years of residence in Brazil, Portuguese, no criminal conviction. The term is reduced to 1 year with a Brazilian spouse, partner or child. The Migration Law does not require renouncing a previous citizenship; Indian law does not allow dual citizenship, so for Indian citizens naturalisation means moving to OCI status, which we discuss separately.

What happens to the status if I sell the property?

Before conversion to an indefinite permit the property is the basis of the status: selling it removes the basis. If you plan to exit the asset earlier than four years, we discuss a replacement property or another route before the deal.

How long does processing take?

The resolution sets no statutory deadline. We give an estimate based on the current practice of the Ministry of Justice and the consulates on the filing date rather than promising ‘a month’. The CRNM card issue time per the gov.br portal is up to 180 calendar days.

Can I include parents or adult children in a Brazilian residence application?

Yes. Article 37 of the Migration Law and Ordinance 12/2018 allow family reunion with ascendants up to the second degree, parents and grandparents, and with descendants up to the second degree. For adult children we prepare proof of dependency; stepchildren are included under 18, up to 24 if studying, or where economically dependent. Parents file with you or later.

How does the investment amount change when filing with the family?

It does not: the threshold of BRL 1,000,000 (or BRL 700,000 in the North and Northeast) is per applicant, and one property covers the whole family through family reunion. The only trap is co-ownership: then the resolution requires the threshold from each co-owner. Only the fees and document translations per person grow.

Do you offer a refund if the application is refused?

Yes. If the application is refused through the fault of our team or an error in building the case, we refund the company's service fee less a minimal retention for costs actually incurred. Refund terms, the payment schedule and the rules on retaining service costs are fixed in the contract before work begins. Before we start, we check your documents and risk history free of charge and tell you about any risks in advance.
