Hungarian residence permit for a girl from Russia as an opportunity to travel and live near her lover

In March 2021, the Moscow office of GARANT.in received a phone call. Twenty-year-old Anastasia R. from Vladimir came to us. The girl had found a vacancy for a nail technician in one of the beauty salons in Budapest and wanted to draw up documents for work in Hungary.

Anastasia did not choose this country by chance, her young man Artem had been working there on a contract for over a year. Restrictions on movement due to the COVID-19 pandemic made their meetings rare, so the girl decided to move to be close to her beloved.

As it turned out, Anastasia's employer did not assist its employees in obtaining a Hungarian residence permit under a labour contract. It was also not possible to obtain a residence permit through the procedure of family reunification, as the young people were not married and had no proof of domestic partnership.

We suggested two ways of solving the problem:

1. conclusion of Anastasia's official marriage with her young man and registration of a residence permit under the reunification procedure;
2. search for another vacancy that would allow the girl to apply for a residence permit for work.

The couple did not plan to marry yet. So Anastasia chose the second option. Artem talked to his employer, and he agreed to help her with employment.

After signing the cooperation agreement, the Garant.in lawyer started to check the provided employment contract template and prepare the package of documents necessary to obtain a D visa and a Hungarian residence permit. 

There were no claims to the terms of the contracts. The question of accommodation remained open. Artem has already started looking for a suitable option on his own, but was not very successful. Then we involved our real estate agent in Budapest, who helped the couple to find a cosy flat near the centre of the Hungarian capital.

In the meantime, the lawyer:

• collected the necessary documents (photo, passport data, job application, rental agreement, letter of purpose of stay in the country, medical insurance, confirmation of payment to the ministry of Foreign Affairs of Hungary through the Enter Hungary system); 
• registered Anastasia at the Hungarian Consulate in Moscow to apply for a visa;

During the two weeks of waiting in the queue at the Consulate, the client's case was completed with a 3-month bank statement; education documents; copies of the domestic and foreign passports; a completed application form 

At the beginning of May, Anastasia received her visa and left for Hungary. Upon arrival, she sent us a signed employment contract, took biometrics and, accompanied by a lawyer, applied for a residence permit at the regional office of the Main Directorate of Migration.

A month later, the client received a residence permit card with a validity period of 2 years at the same office.

Results

The work on the case lasted 2 months. During this time we helped Anastasia not only with obtaining a Hungarian residence permit, but also with finding accommodation and drawing up a rental agreement.

The client and her boyfriend visited seven Schengen countries over the summer and continue travelling, discovering the world with the visa-free travel, which is provided by the Hungarian residence permit.
