Alexander R. from Minsk, 33 years old. Married, has a ten-year-old son. At the end of 2020 he went on a tourist visa to Budapest for a visit. This trip completely changed his life. Having learned from friends about the benefits of a residence permit for Hungary, he caught fire with the idea of moving. The basis for obtaining this status in Alexander's case could only be an employment contract with a local company. Therefore, the young man without delay began to look for a job. But the short-term tourist visa was expiring and it was time to return home. A week before departure Alexander managed to find a vacancy at an automobile factory, but he did not have time to solve the housing issue.
Alexander learned about the Emigration Center GARANT.in from a friend from Ukraine, who cooperated with us in 2020 and was satisfied with the result.
The client applied in January 2021 with a request to provide professional assistance in obtaining a Hungarian residence permit under a labor contract for him, as well as to help his family with moving to a foreign country.
The process of applying for residence permit on the basic of an employment contract
The cooperation started with checking the labor agreement with the employer in Hungary, which the client was going to sign. There were no legal claims to the agreement. Its existence allowed the client to become a participant in the residence permit program.
To fulfill the second condition - permanent residence in the country - we involved local real estate agents, with whom we have long been cooperating. Within a week, the realtor found Alexander a good apartment not far from his workplace and a five-minute walk from his school. The lease agreement was signed for 2 years, as required by the program.
Meanwhile, the lawyer who handled Alexander's case did the following work:
- Enrolled the client at the Hungarian Consulate in Belarus to obtain a “D” visa and registered his data through the Enter Hungary system with the Hungarian Ministry of Foreign Affairs.
- Prepared a package of documents:
- 3 months bank statement in English;
- education documents with official Hungarian translation;
- copies of internal and foreign passports;
- medical insurance; preliminary employment contract;
- completed application form and Annex 10 in two languages - English and Hungarian;
- photographs;
- a receipt for payment of the consular fee.
The wait in line at the consulate this time lasted only 10 days.
In early February, Alexander arrived in Budapest with his visa in hand.
Within a month, we organized the client's biometrics and helped him obtain a residence permit card at the regional office of the Hungarian Directorate General of Migration.
The next stage is the relocation of his wife and son Alexander through the reunification procedure
The lawyer prepared the following documents for the procedure of residence permit registration for the wife and ten-year-old child:
- a copy of the spouse's passport and TIN;
- a scan copy of Alexander's Hungarian residence permit;
- documents confirming family ties - marriage certificate and child's birth certificate;
- a certificate of the spouse's criminal record;
In March, the application was submitted to the Hungarian Consulate in Belarus.
According to the results of the check of the Hungarian Ministry of Foreign Affairs, where such applications are forwarded, the clients received a positive response. The documents allowing entry into the territory of the country were Schengen visas. Upon arrival in Budapest, Alexander's wife and son received residence permit cards at the office of the Main Directorate of Migration.
Case results
Alexander, as the main applicant, obtained a Hungarian residence permit on the basis of a labor contract. The client's wife and child were able to move with him through the family reunification procedure.
