Hungarian residence permit on the basis of an employment contract

He contacted us at the end of June 2020 with a request for a residence permit in Hungary.

The need to obtain legal status arose due to Viktor's employment at a car factory near Budapest. According to the terms of the contract, he had to start work on 1 October.

Friends of our client, who have been living in Hungary for several years, told him about the possibility of obtaining a residence permit if he had a labour contract and housing in this country.

The advantages of the Hungarian residency status for the client were obvious, as the country is a member of the European Union. But he had neither time nor enough information to understand all the intricacies of the procedure. That is why Victor decided to enlist the help of specialists.

Registration process

After concluding the co-operation agreement, the lawyers started to collect the necessary documents. But initially they checked the firm; the employer and the employment contract which Victor was going to sign. Все оказалось прозрачно и легально. The duration of the contract (2 years) corresponded to the conditions of the Hungarian residence permit programme.

The question of accommodation remained open. Usually in such situations the plant provides its employees with a hostel, but not this time. There were no rooms available due to the renovation of the buildings. So we contacted local estate agents in Budapest and found Victor a suitable option. The lease was finished in a couple of days.

In the meantime, the lawyers had already collected a package of necessary documents (photo, passport details, job application, rental agreement, letter of purpose for staying in the country, medical insurance, proof of payment of administrative fees) and submitted an electronic application for a residence permit to the Hungarian Ministry of Foreign Affairs via the system. We also made an appointment with the Hungarian Consulate to apply for a visa.

While waiting in the queue, the client's case was completed with:

• a 3-month bank statement in English;
• education documents with official Hungarian translation;
• copies of domestic and foreign passports;
• a completed application form and Annex 10 in two languages - English and Hungarian;
• photographs;

Victor received his visa in the first days of August, and a ticket to Budapest was already booked for the 10th of the same month.

Upon arrival in Hungary, client signed a contract with a client with employer, took biometrics and, accompanied by a lawyer, applied for a resident permit at the regional office of the Main Directorate of Migration. He received his resident permit card a month later 

Case results

With our help Victor S. received a residence permit in an EU member state for 2 years. In the future, if the conditions of the programme are met, the residence permit can be extended. The client started working on the date specified by the employer. All questions about obtaining legal residence status in Hungary had been resolved by that time.
